Health Screening & Liability Waiver — at-home use of the Tirata beta app
Version 1.0 — Effective June 2026
Part A — Health Screening (PAR-Q)
Tirata is a strength training application for competitive cyclists. As a Tirata beta tester, you may perform exercises prescribed by the Product on your own — including resistance training, dynamic movement, and explosive efforts — typically at home and without supervision. Please read each of the questions below carefully and answer them honestly to yourself before you begin training with the Product. If your answer to any question is YES, you should consult a qualified physician before performing any exercise from the Product.
Consider each of the following questions:
1. Has a doctor ever said that you have a heart condition, OR that you should only do physical activity recommended by a doctor?
2. Do you feel pain in your chest when you do physical activity?
3. In the past month, have you had chest pain when you were not doing physical activity?
4. Do you lose your balance because of dizziness, or have you ever lost consciousness during exercise?
5. Do you have a bone or joint problem (for example, back, knee, hip, or shoulder) that could be made worse by a change in your physical activity?
6. Is your doctor currently prescribing drugs (for example, water pills) for your blood pressure or heart condition?
7. Do you know of any other reason why you should not do physical activity?
8. Are you currently pregnant, or have you given birth within the last 12 weeks?
By accepting this Waiver, I confirm that I have read and considered each of the questions above. I confirm that my answer to every question is NO and that I am not aware of any reason I should not perform physical activity — OR, if my answer to any question is YES, that I have obtained clearance from a qualified medical professional to participate in physical activity, or will not perform any physical exercise from the Product until I have obtained that clearance.
Part B — Assumption of Risk and Liability Waiver
I, the undersigned (“Participant”), wish to participate in the beta testing of Tirata’s strength training mobile application (the “Product”), provided by Tirata, Inc., a Delaware corporation (“Tirata”). I understand that I will use the Product and perform any exercises it prescribes on my own, typically at home and without supervision by Tirata or any trained professional.
1. Acknowledgment of risks
I acknowledge that physical activity, strength training, and related exercise carry inherent risks, including but not limited to: muscle strains and tears; joint, ligament, and tendon injury; bone fracture; falls and impact injury; cardiovascular events including heart attack and stroke; aggravation of pre-existing conditions; and, in rare circumstances, serious injury or death.
I understand that I will be exercising on my own, that no Tirata personnel or trained professional will be present, and that these risks exist regardless.
2. Assumption of risk
I voluntarily and knowingly assume all risks associated with my participation, whether identified above or not. I am participating in the beta and performing any exercises of my own free will.
3. Health representations
I represent that:
I have completed Part A truthfully and to the best of my knowledge.
I am in sufficient physical health to perform the activities I will engage in while using the Product.
If a medical professional has placed restrictions on my physical activity, I will follow those restrictions and will not exceed them when performing exercises from the Product.
I will stop exercising immediately, and seek medical attention if appropriate, if I experience pain, dizziness, shortness of breath, chest tightness, or any other concerning symptom while using the Product.
4. Release and waiver of liability
To the fullest extent permitted by law, I release, waive, and discharge Tirata, its officers, directors, employees, contractors, agents, and affiliates (collectively, the “Released Parties”) from any and all claims, demands, losses, damages, or causes of action of any kind, whether known or unknown, arising out of or related to my participation in the beta and my use of the Product, including any injury, illness, or other harm I may suffer.
This release does not apply to claims that cannot be waived under applicable law, including claims arising from gross negligence or willful misconduct.
5. No supervision; medical emergencies
Because I use the Product on my own, no Tirata personnel will be present when I exercise. I am solely responsible for monitoring my own condition and for contacting emergency services and seeking care if needed. I understand that Tirata is not a medical provider, has no obligation to provide or summon medical care, and that I am responsible for any costs of medical treatment I receive.
6. Right to stop
I understand that I may stop any exercise or end my participation in the beta at any time, for any reason, without penalty.
7. Not medical or fitness advice
I understand that the Product provides general fitness programming guidance, not individualized medical advice. Programming provided by the Product is general guidance and is not a substitute for advice from a qualified physician, physical therapist, or certified strength coach.
8. Governing law
This waiver is governed by the laws of the State of California, without regard to its conflict-of-laws principles.
Acknowledgment
I have read this Health Screening and Liability Waiver, understand it, and agree to its terms. I am at least 18 years old. I confirm that all information I have provided in Part A is accurate to the best of my knowledge.
Accepted electronically. By checking the consent box and submitting the Tirata beta application, Participant indicates that Participant has read, understood, and agrees to this Health Screening and Liability Waiver, is at least 18 years old, and confirms that the Part A information is accurate. Tirata retains a record of acceptance that includes the name and email address Participant provided and the date and time of acceptance, which together constitute Participant’s electronic signature under the U.S. E-SIGN Act and applicable state law.
